Trademark Registration Procedure in India

The process is governed by the Controller General of Patents, Designs and Trade Marks, under the Ministry of Commerce and Industry.

1. Trademark Search

Before filing, conduct a comprehensive search on the IP india website or via a Vienna Code search for figurative marks. This ensures the proposed mark is unique and not deceptively similar to existing ones.

2. Class Selection

Trademarks are categorized under 45 classes as per the NICE Classification. Accurate class selection is crucial. For example:

• Class 25: Clothing, footwear, headgear
• Class 5: Pharmaceuticals and Ayurvedic products
• Class 30: Food items like spices and snacks

3. Application Filing

File Form TM-A either online via the IP india portal or physically at the Trademark Registry. Key details include:

• Priority claim (if applicable)

4. Examination

The Trademark Office examines the application for:

5. Publication in Journal
